Terms and Conditions – LMD Managers Community

§ 1 General Provisions

  1. These Terms and Conditions set forth the terms of participation in the community named “LMD Managers Community” (hereinafter: the Community) organized by TOMCZAK STANISŁAWSKI MARKETING sp. z o.o. with its registered office in Poznań.
  2. Unless expressly stated otherwise in the Terms and Conditions, the following terms written with a capital letter have the following meanings:
    1. Price List means the applicable price list for participation in the Community, available on the website https://legalmarketday.com/ and in the Organizer’s profile on the EasyCart platform.
    2. Business Day means any day of the week from Monday to Friday, excluding statutory public holidays;
    3. Registration Form means the form accessible via the link on the website https://legalmarketday.com and the EasyCart platform through which Registration takes place
    4. Organizer means TOMCZAK STANISŁAWSKI MARKETING sp. z o.o. with its registered office in Poznań, at ul. Seweryna Mielżyńskiego 14, 61-725 Poznań, entered in the register of entrepreneurs maintained by the District Court Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register, under KRS number 0000626663; Tax ID (NIP): 7831744095, REGON: 364866832, with share capital of PLN 50,000 fully paid, contact telephone number 501635171, e-mail address: biuro@tomczak-stanislawski.pl
    5. Confirmation of Participation in the Community information sent by the Organizer to the Participant at the e-mail address provided in the Registration Form, concluding the Registration process;
    6. Terms and Conditions means these terms and conditions;
    7. Registration the process of enrolling a Participant for membership in the Community;
    8. Participant a natural person who has completed Registration and is to join the Community. Such person must be the owner of a law firm or consulting firm or hold the role of partner in such a firm. Other persons may be accepted by the Organizer on an individual and final decision basis.
    9. Professional a natural person, legal entity, or organizational unit without legal personality, being a provider of services, products, or other commercial solutions for firms providing professional services (including, among others, law firms, tax advisory firms, consulting firms), who is to participate in the Community.
  3. The Organizer reserves the right to cancel a reservation if it turns out that the person who registered or was registered to participate in the Community or one of the meetings organized within it does not meet the conditions specified in point 2.9 above.
  4. Registration for participation in the Community is equivalent to acceptance of the Terms and Conditions, including the obligation to pay the fee in accordance with the rates specified in the Price List.
  5. The above terms written in the plural refer to expressions in the singular, unless otherwise directly stated in the Terms and Conditions.
  6. References to points and letters contained in these Terms and Conditions refer to points and letters in the same paragraph as the reference, unless the reference indicates another paragraph.

§ 2 Registration

  1. Registration takes place by completing and submitting the Registration Form and paying the fee for participation in the Community in accordance with the rates specified in the Price List.
  2. By submitting the Registration Form to the Organizer, the Participant makes an offer to the Organizer to conclude an Agreement on the terms resulting from the content of the Terms and Conditions, the Price List, and the Registration Form.
  3. After receiving the Registration Form, the Organizer sends a message with a link to the VAT invoice to the Participant’s e-mail address provided in the Registration Form.
  4. A maximum of two persons representing one Law Firm or Consulting Firm may join the Community.

§ 3 Payment for Participation in the Community

  1. The Price List indicates the amount of the fee for one person’s participation in the Community. The fee includes the services indicated on the website https://legalmarketday.com and on the EasyCart platform. The participation fee does not include the Participant’s travel costs to the Community meeting venue, accommodation, or meals.
  2. The participation fee is paid via the online payment system.
  3. By submitting the Registration Form to the Organizer, the Participant consents to the sending and receipt of the VAT invoice electronically, to the e-mail address provided in the Registration Form – the VAT invoice after payment of the fee for participation in the Community is sent to the Participant’s e-mail address provided in the Registration Form.
  4. If, after payment is made, it turns out that the Participant’s participation in the Community is impossible due to the exhaustion of the limit of places, the Organizer immediately refunds the Participant the fee paid for the Participant’s participation in the Community.
  5. If the fee for participation in the Community is not paid in full within 7 days from the Organizer’s sending of the information referred to in § 2 point 5 of the Terms and Conditions, the Registration is deemed to be cancelled in its entirety.

§ 4 Confirmation of Participation in the Community

  1. The Organizer sends the Confirmation of Participation in the Community if the following conditions are met:
    1. The Organizer has received a correctly completed Registration Form;
    2. The Organizer has received the fee for participation in the Community (in full or in part with the obligation to pay the full price);
    3. The limit of available places for participation in the Community has not been exhausted.
  2. The Confirmation of Participation in the Community constitutes a declaration of acceptance by the Organizer of the Participant’s offer on the terms resulting from the content of the Terms and Conditions, the Price List, and the Registration Form.
  3. The place of conclusion of the agreement is Poznań.
  4. The Agreement is concluded on the date of sending the Confirmation of Participation by the Organizer and remains in force until April 30, 2025.

§ 5 Participant’s Obligations

  1. Participants are obliged to familiarize themselves with and comply with the Terms and Conditions.
  2. Participants are obliged to familiarize themselves with and comply with the regulations for the use of the facilities where the Community meetings will take place.
  3. The Organizer reserves the right to remove a Professional or a person outside the target group (owners and persons at partner level in law firms and consulting firms in the tax & legal industry) from the list of Participants if they purchased a ticket without prior arrangement of the participation model with the Organizer. Professionals are requested to contact the Organizer at hello@legalmarketday.com before purchasing a ticket.

§ 6 Limitation of the Organizer’s Liability

  1. To the extent permitted by law, the Organizer’s liability for damages, and in particular for damages resulting from non-performance or improper performance of the agreement or from withdrawal from the agreement, caused to Participants is limited to:
    1. the amount of the fee paid for the Participant’s participation in the Community – in the case of damages caused to the Participant
    2. the amount of the sum of fees paid by the Participant for the Participant’s participation in the Community – in the case of damages caused to the Participant.
  2. This applies to all grounds of liability, including tort liability. The provisions of this paragraph do not apply to Participants who are consumers.

§ 7 Changes to the Community Program

  1. The Organizer reserves the right to change the Community program, i.e., among others, speakers, topics and times of presentations, as well as the date and place of Community meetings.
  2. The Organizer will inform the Participant of the changes referred to in point 1 by means of announcements that will be available on the Community website accessible at https://legalmarketday.com or by electronic correspondence to the Participant’s address provided during registration.
  3. The Organizer reserves the right to withdraw from the agreement (cancel the Community meeting) by the date of the meeting. The Organizer does not have the right to withdraw from the agreement in the part specified in § 6 of the Terms and Conditions.
  4. The Organizer reserves the right to withdraw from the agreement (cancel participation) with respect to individual participants by the date of the meeting.
    1. if an error occurs in the computer system during Registration (e.g., a form failure that results in incorrect pricing, etc.). The Organizer does not have the right to withdraw from the agreement in the part specified in § 6 of the Terms and Conditions.
    2. if during Registration a person representing a company that is a provider of services, products, or other commercial solutions for firms providing professional services (including, among others, law firms, tax advisory firms, consulting firms) registers as a Participant rather than as a Professional.
  5. The Organizer submits the declaration of withdrawal from the agreement via e-mail to the Participant’s address provided in the Registration Form.
  6. In the event of withdrawal from the agreement by the Organizer, the Organizer will refund the fee paid for participation in the Community to the bank account indicated by the Participant, within 30 Business Days from the date of submitting the declaration of withdrawal.

§ 8 Withdrawal from Participation

  1. The Participant may submit a declaration of termination of the agreement via e-mail to hello@legalmarketday.com.
  2. Withdrawal from participation in the Community is not grounds for a refund of participation costs or for refusal to make the second partial payment in the case of installment payment.
  3. Regardless of the right provided above, a Participant who is a consumer may withdraw from the agreement without giving a reason and without incurring costs within 14 days from the conclusion of the agreement. To withdraw from the agreement, the consumer may use the sample form, a template of which is available at the e-mail address hello@legalmarketday.com, but this is not mandatory.

§ 9 Complaints

  1. The Participant may submit a complaint via e-mail to: hello@legalmarketday.com, as well as by post to the Organizer’s registered office address. Complaints may be submitted no later than 14 days after the end of the Community meeting that will take place in November 2024. In the case of submitting a complaint by post, the postmark date determines compliance with the deadline.
  2. The complaint should contain at least the following information:
    1. identification of the Participant – name and surname/company name, correspondence address, e-mail address, contact telephone number,
    2. subject of the complaint;
    3. indication of the factual circumstances justifying the complaint;
  3. The Organizer considers complaints within 14 Business Days from the moment of receipt.
  4. The Organizer may extend the deadline indicated in point 3.
  5. The Organizer will inform the complainant of this, indicating the reasons for extending the deadline. At the same time, the Organizer sets a new deadline for considering the complaint.

§ 10 Personal Data Protection

  1. TOMCZAK STANISŁAWSKI MARKETING sp. z o.o. with its registered office in Poznań, at ul.   2. Participants’ personal data are processed for the purpose of ensuring the functioning of the Community, including conducting meetings, including, among others, creating a list of Community Participants, settling fees for participation in the Community, confirming attendance, and potentially pursuing claims for the fee for participation in the Community. Data processing also includes the Participant’s image, in the form of photographs and video recordings made during Community meetings.
  3. Data subjects have the right to access the content of their data and to correct it.
  4. Providing personal data is voluntary, but it is necessary for the purposes of concluding and performing the agreement.
  5. Product sales are conducted through the Stripe platform, and the seller additionally uses the easycart.pl service, within which payment is processed (purchase page). By providing data on the purchase page, the User agrees to their transfer to EasyCart and Stripe in accordance with the terms and conditions and privacy policy. These documents are linked on the cart page.

§ 11 Out-of-Court Methods of Complaint Resolution and Pursuing Claims and Rules of Access to These Procedures (APPLIES ONLY TO CONSUMERS)

  1. Detailed information regarding the possibility for a Participant who is a consumer to use out-of-court methods of complaint resolution and pursuing claims, as well as the rules of access to these procedures, is available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of the Trade Inspection, and at the following internet address of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl
  2. A consumer has the following example possibilities to use out-of-court methods of complaint resolution and pursuing claims:
    1. A consumer is entitled to apply to a permanent consumer arbitration court, referred to in Article 37 of the Act of December 15, 2000 on Trade Inspection (Journal of Laws 2001 No. 4 item 25 as amended), with a request to resolve a dispute arising from the concluded Sales Agreement. The regulations on the organization and operation of permanent consumer arbitration courts are set forth in the regulation of the Minister of Justice of September 25, 2001 on determining the regulations on the organization and operation of permanent consumer arbitration courts (Journal of Laws 2001, No. 113, item 1214).
    2. A consumer is entitled to apply to the provincial inspector of the Trade Inspection, in accordance with Article 36 of the Act of December 15, 2000 on Trade Inspection (Journal of Laws 2001 No. 4 item 25 as amended), with a request to initiate mediation proceedings for the amicable resolution of a dispute between the Consumer and the Organizer. Information on the rules and procedure of mediation conducted by the provincial inspector of the Trade Inspection is available at the offices and on the websites of individual Provincial Inspectorates of the Trade Inspection.
    3. A consumer may obtain free information on assistance in resolving a dispute between the Consumer and the Organizer, also using the free assistance of a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection. § 12 Final Provisions

  1. In matters not regulated by the Terms and Conditions, the provisions of Polish law shall apply accordingly.
  2. The court with jurisdiction over disputes arising from the agreement is the court with jurisdiction over the Organizer’s registered office. This provision does not apply to Participants who are consumers.
  3. The Organizer reserves the right to introduce changes to the Terms and Conditions.
  4. The Organizer will inform the Participant of the changes referred to in point 3 via e-mail to the addresses provided in the Registration Form.
  5. In the event of changes referred to in point 3, the Participant has the right to withdraw from the agreement within 5 (five) Business Days from obtaining information about the change, but no later than before the date of commencement of the Community meeting that will take place on June 11, 2024. The Participant does not have the right to withdraw from the agreement in the part specified in § 6 of the Terms and Conditions.
  6. The Participant may submit a declaration of withdrawal from the agreement via e-mail to hello@legalmarketday.com. The declaration should indicate that the reason for withdrawal is the change in the content of the Terms and Conditions. In the absence of such indication, § 8 of the Terms and Conditions applies.
  7. Digital content provided to Participants who are consumers includes in particular:
    1. the message referred to in § 2 paragraph 5 of the Terms and Conditions;
    2. VAT invoices
    3. Confirmation of Participation in the Community

    and the Terms and Conditions, if the Participant decides to download them. The Organizer does not introduce into the ICT system used by the Participant any software or data other than those listed above. The order placement process involves typical risks associated with using the Internet for data transmission purposes. The ICT system used by the Organizer employs techniques commonly accepted in the market aimed at ensuring that the Participant places orders in a manner that prevents unauthorized persons from accessing the content of the transmission.

  8. Essential for obtaining access to the digital content listed in paragraph 7 is possession of:
    1. a device allowing access to the Internet;
    2. access to the Internet;
    3. a web browser Firefox 7 or newer or Internet Explorer 9 or newer or Chrome 15 or newer or Opera 11.52 or newer.
    4. a program capable of opening files in PDF format, e.g., Acrobat Reader 9.5 or newer.
  9. The digital content listed in paragraph 7 is not protected against the introduction of changes.
  10. As a rule, this content can be reproduced and saved in a format other than that in which the Organizer sent it. As a result of such action, the digital content may be altered, its properties may also change, and loss of some information may also occur.
  11. The Terms and Conditions enter into force on April 29, 2024.
